The Contract Between Us
Any contract for purchases made through the website will be with Bayside Marine ltd. Bayside Marine ltd must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed.
Once payment has been received Bayside Marine ltd will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. bayside marine ltd’s acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
If, for any reason, the item you have ordered is currently out of stock, you will receive an email highlighting this issue and, where possible, an estimated date of arrival for the product to come back in. If we continue to have issues in regards to getting your item back into stock we reserve the right to cancel our contract with you by means of fully refunding your order.
Bayside Marine ltd is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.
General Terms
These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non–exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions.
Additional terms and conditions may apply for prize competitions, online bidding, pre–release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.

Payment Details
Bayside Marine ltd accepts payment by Visa, MasterCard, American Express, Switch, Maestro and Delta. All product prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion.
Upon receiving your order Bayside Marine ltd carries out a standard pre-authorisation check on your payment card to ensure there are sufficient funds in order to fulfil the transaction. No payment is debited from your card during this pre-authorisation check. Your card will only be charged upon dispatch of the items in your order. Your card will not be debited for items in your order which have not been dispatched, apart from magazine subscriptions, which, due to their nature are invoiced before the magazine is dispatched.
Delivery
Delivery can be to any address as long as the address at which your payment card is registered is also present on your order. Please make sure you keep the receipt enclosed with your goods.
When you add products to your Shopping Basket, the appropriate delivery charge will be added automatically. You will always be able to see this charge before submitting your order.
All delivery timescales are subject to product and delivery slot availability. Small parcels may be delivered via Royal Mail or suitable courier.
The contents of your order and your delivery postcode area will determine which delivery services you will be offered. We do not deliver to Post Office (P.O.) boxes or shipping agent addresses.
Delivery will be between the hours of 7am and 6pm; we are unable to confirm a time although our courier may provide details at their convenience.
Bayside Marine Ltd will select the most appropriate carrier for your goods. This means your delivery may arrive in more than one batch to ensure your order is transported in the best possible way.
Whilst every reasonable effort shall be made to keep to any delivery date, time of delivery shall not be of the essence and Bayside Marine ltd shall not be liable for any losses, costs, damages or expenses incurred by the customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date. The risk in the goods shall pass from the company to the customer upon delivery of such goods to the customer.
If a large order is placed (for example, paint) we may send your order out in separate boxes. When accepting delivery of your order ensure that you have received the full amount of parcels. Please inform us within 5 days if there are any issues to ensure the swiftest possible solution.
Availability of Goods You Order
Bayside Marine does their best to keep every item they have for sale in stock, but in rare cases an order may be placed for an item that we are currently out of. If Bayside Marine ltd has insufficient stock to deliver the goods ordered by you we will notify you by email as soon as possible to highlight this issue and, when possible, give an estimate of when goods are expected to come back into stock. At any time, before goods have been dispatched, you may cancel the order for a full refund. Bayside Marine ltd will not be obliged to offer any additional compensation for disappointment suffered.
Please note: we endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price can take a few hours to update.
Changes to This Agreement
Bayside Marine Ltd reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
Returned Goods
If you need to return a product purchased from Bayside Marine ltd then you have 28 working days to do so. The returned goods must be in a resaleable state and any goods or accessories that accompany the returned product must also come back to us.
If the return is due to a change of mind and no fault on our part then you will be liable to cover the return postage charge, and any refund will not include the original carriage cost.
Please note that any item that has been custom made for you (for example, a custom colour mix of Jotun paint or a rope splice) is not liable for a refund if no mistake has been made on our part.
The goods should also be returned with their original box, packing and accessories.
If the return is due to missing or faulty parts then we will offer a full refund or replacement provided we are aware of this within 10 working days.
We will not refund carriage on Clothing, headwear or Footwear due to sizing issues.
Any refund, which is due to a fault or other defect, will include a refund of the applicable delivery charge.
